Kiowa County Sheriff VS California Criminal

On August 25, 2022 at approximately 1135, Deputy West was called to Highway 287 mm 113 for an occupant who appeared to be using controlled substances while in control of a motor vehicle. Deputy West witnessed the driver drinking an alcoholic beverage and smoking what appeared to be marijuana, while searching for his driver’s license. Deputy West called for backup, and made contact again after Undersheriff Murdock and Deputy Negley came on scene. 

Deputies attempted to detain the driver, who fled the scene and was throwing evidence out the car window. At approximately mile marker 119, the driver went into a construction zone with workers present. Deputies backed off and maintained the speed limit while the driver sped off at an approximate speed of 95 mph in a posted 40 mph construction zone. After ensuring the safety of the workers and traffic, deputies reinitiated pursuit at the Kiowa/Cheyenne line.

The pursuit maintained speeds of 70 mile per hour until the driver turned off on Highway 40 Eastbound. Deputies from the Cheyenne County Sheriff’s Office were waiting to deploy stop sticks at two locations on Hwy 40. At mile marker 458 a Cheyenne County Deputy successfully deployed stop sticks. The pursuit came to a slow crawl and the driver went off into the ditch after 3 tires went flat.

Deputies arrested Eli Nicolas (DOB 11/10/1988) of California on:  

18-9-116.5(1)  Felony Eluding (Felony 5), 42-4-1301(1)(a) Driving Under the Influence of Alcohol and Drugs- refusal (Misdemeanor 1), 42-4-1401 Reckless driving, 18-3-208 Reckless Endangerment (Misdemeanor 2),  18-3-205(b) (IV) Attempted vehicular assault (Felony 5),  42-4-1101 (12)(b) Speeding 40+ over in construction, 18-8-104 (1)(a) Obstructing a peace officer (Misdemeanor 2),  Tampering with evidence 18-8-610(1)(a) (Felony 6)

Nicolas is being held at the Prowers County Jail on $50,000 bond.

Everyone is presumed innocent until proven guilty in the court of law.
